Feasy Terms of Service

Introduction

The terms and conditions herein (“Terms of Service”) describe the conditions subject to which a user (“User” or “You”) may use http://www.getfeasy.com (“Feasy Website”) , and the digital concierge services provided through Feasy Chatbot (“Feasy Services” and together with Feasy Website ‘Feasy’). Feasy is provided by Amadeus IT Group SA, a company with headquarter at Calle Salvador de Madariaga 1, 28027 Madrid, Spain (“Amadeus”, “we” or “us”) and is aimed at making your life freaking easy when you travel. 

By accessing and using Feasy, you agree to be bound by these Terms of Service and any other terms incorporated herein by reference such as Feasy Privacy Policy https://getfeasy.com/privacy-policy/. If you don’t agree to these Terms of Service, you may not access and use Feasy. We recommend that you read these Terms of Service carefully in order to understand Your and Amadeus’ rights and obligations applicable to Feasy.

When accessing or buying services provided by third parties in connection with Feasy Service(s), you will be subject to those third parties’ terms and conditions.

Use of Feasy

A: Age restriction. Feasy is available only to natural persons over the age of legal majority in their country and who can enter into legally binding agreement(s) under applicable law. If you are not the age of legal majority, you should not use Feasy.

B: Service Overview:

Feasy encompasses usage of:

• Feasy Website which is designed to provide you some generic travel information through Feasy Landbot(s) and to enable you to create your Feasy Account and;
• Feasy Service(s) which are designed to provide you personalized trip information and digital concierge services through Feasy Chatbot, a conversational virtual assistant available on Facebook Messenger or WhatsApp (“Platform(s)”). In order to access Feasy Service(s), you shall download the Platform of your choice on your mobile and create a Feasy Account as described in Section C .

All the information made available to you through usage Feasy shall be treated as Feasy Content.

C: Use of Feasy Website:

Feasy landbot(s)

By visiting Feasy Website, you will have access to Feasy Landbots which may provide you some generic travel information without requiring you to create a Feasy Account. 

For example, Covid19 Landbot will provide you relevant information relating to the Covid-19 crisis updated on a regular basis. The information provided on Covid19 Landbot is shared by Riskline (European Security Institute) our third-party provider. Amadeus does not intervene in the process of drafting the information therein and is not responsible for its content. Therefore, Amadeus disclaims any liability for its accuracy or completeness. We strongly advise that you check with your airline and local authorities before you travel due to the ever-changing nature of the regulations.

Account creation

If you want to receive Feasy Servies, you should create a Feasy Account. 

Creation of a Feasy Account is avaible directly on Feasy Website, or by first engaging with us on your selected Platform or on a Feasy Landbot and then confirming your Feasy Account on Feasy Website.

When creating your Feasy Account, you shall provide accurate and complete information about yourself and update your information as necessary to keep it accurate and complete. Make sure that the e-mail address and/or mobile number you provide is your default one – otherwise, we won’t be able to redirect you to Feasy Chatbot on your selected Platform. The Personal Data collected during the registration process will be subject to Feasy Privacy Policy https://getfeasy.com/privacy-policy/.

You may close your Feasy Account at any time. If you do so, all your Personal Data will be deleted accordingly.

D: Use of Feasy Service(s):

After your account creation, we will ask you to confirm through Feasy Chatbot that you want to receive Feasy Service(s). By accepting and engaging into a discussion with us on your selected Platform Chatbot, you understand that the information you provide will be accessed and processed by such Platform a subject to their terms and privacy policy. We have no control over the usage that is made of your information by such Platform and hereby disclaim all warranties, express or implied, as to this Platform.

Each time we find a trip associated to your e-mail address in our systems, , we will reach out to you through your selected Platform and ask you whether you want to receive Feasy Service(s) for such trip. 

If we have not identified any trip associated to your e-mail account, we will suggest from time to time that you provide details about your next trip (booking confirmation) by sending an e-mail to me@getfeasy.com.

The more we know about your trip and your interests, the more personalized information and services we will be able to provide you through Feasy Chatbot. We will therefore ask you from time to time to complete your profile and provide feedback about our services. Please note that providing such information is not mandatory and that you can skip at any time any Feasy Service(s) suggested to you through Feasy Chatbot. 

Feasy Service(s) may include third-party services which can be accessed and booked through links we provide you. If you confirm that you want to book a service with a third-party provider, we may pre-fill the interface with some of your personal information required by the third-party provider to facilitate your booking process. However, your personal information will not be shared with the third-party provider until you confirm the booking.

E: Intellectual Property Rights and Scope of Use:

Any intellectual property rights associated with Feasy remain the sole property of Amadeus, its affiliates or licensors (as the case may be) and nothing in these Terms of Service intends to transfer any intellectual property rights to, or to vest any intellectual property rights in you.

You may not use Feasy to: a) copy, transmit, re-distribute, reproduce, replicate, repost or create derivative based on Feasy Content and/or Feasy Services or any portion thereof, including incorporate any part of Feasy Content and/or Feasy Services into any other website or service; b) try to modify, reverse engineer, reverse assemble or otherwise alter Feasy Chatbot (except to the extent this is authorized by applicable law); c) do anything that is prohibited under applicable law; d) upload or transmit viruses or any other type of malicious code, spam, spyware or malware that may compromise the functionality of Feasy Chatbot and/or Feasy Service(s); e) to share content that is misleading, inappropriate, unlawful, harmful, threatening, abusing, defamatory, pornographic, libelous, invasive or hateful; f) for any commercial purposes.

F: Closure of Feasy Account

If you have created a Feasy Account and wish to stop accessing Feasy Services and terminate these Terms and Conditions, you can do so at any time by closing you account on Feasy Website and no longer accessing the Services. If you do so, all you Personal Data will be deleted accordingly.

Availability of Feasy Chatbot

Feasy Chatbot is designed to be available 24h/24, except for any maintenance purposes, force majeure event or any other event out of Amadeus control.

Amadeus does not guarantee the availability of Feasy Chatbot and reserves the right to modify or discontinue Feasy Chatbot and Feasy Service(s), on a temporary or permanent basis, at any time with no liability towards you or any third party. 

If Amadeus believes that you are making unauthorized use of Feasy Chatbot or that you are in violation of these Terms of Services, it may suspend or terminate your access to Feasy Service(s) with or without notice without any liability whatsoever towards you.

User Content

You are solely responsible for the content, conversations, feedback or other materials you transmit through Feasy Chatbot and/or Feasy Service(s) (“User Content”).

You grant to Amadeus a perpetual, nonexclusive, worldwide, royalty free, fully paid up, transferable license to use the User Content as necessary for Amadeus to provide Feasy Service(s) to you and for any internal purposes, including to improve Feasy Service(s).

Data Protection

All the Personal Data collected during registration process or through your use of Feasy Chatbot will be subject to Feasy Privacy Policy https://getfeasy.com/privacy-policy

Third-Parties Website and Content

Feasy Service(s) may contain links to third-party providers websites or interfaces to book services on third-party websites. Such websites are controlled by independent parties under which Amadeus has no control. Although Feasy Service(s) provides information about third-party suppliers and facilitate bookings with these third-party providers, such Service(s) not constitute any sponsorship, affiliation or endorsement of these third-party providers.

We remind you that by accessing third-party websites or by booking third-party services suggested through Feasy Chatbot , you agree to be bound by these third-parties’ policies and terms and conditions. We encourage you to review these terms and conditions and policies and to use them at your own risk. 

YOU HEREBY ACKNOWLEDGE AND AGREE THAT AMADEUS WILL NOT BE A PARTY TO ANY AGREEMENT ENTERED WITH ANY SUCH THIRD-PARTY AND WILL NOT BE RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN SUCH THIRD-PARTIES’ WEBSITES OR FOR ANY DIRECT OR INDIRECT CLAIM, BREACH, LOSS OR DAMAGE CAUSED OR ALLEGEDLY CAUSED BY OR IN CONNECTION WITH THE ACCESS OR USE OF SUCH THIRD-PARTIES’ WEBSITES.

Disclaimer of Warranties and Limitation of Liability

AMADEUS HAS MANY SOURCES OF INFORMATION AND DATA THAT MAKE UP THE INFORMATION MADE AVAILABLE THROUGH FEASY. ALTHOUGH AMADEUS TRIES TO PROVIDE ACCURATE INFORMATION, FEASY MAY BE SUBJECT TO OMISSIONS AND ERRORS. FEASY WEBSITE, AND FEASY SERVICES A ARE PROVIDED ‘AS IS’. TO THE FULLEST EXTENT PERMITTED BY LAW, AMADEUS DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD-PARTY’S RIGHTS, ACCURACY OF INFORMATION AND FITNESS FOR A PARTICULAR PURPOSE. AMADEUS MAKES NO REPRESENTATIONS OR WARRANTIES THAT FEASY WEBSITE, FEASY SERVICE(S) AND FEASY CONTENT M WILL MEET YOUR REQUIREMENTS AND BE SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, TIMELY, UNINTERRUPTED, ACCURATE, COMPLETE OR RELIABLE. YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF FEASY IS AT YOUR OWN RISK AND THAT FEASY IS MADE AVAILABLE TO YOU AT NO CHARGE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMADEUS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL LOSSES OR DAMAGES OR ANY LOSS OF INCOME, PROFITS, GOODWILL ARISING OUT OF OR IN ANY WAY RELATED TO i) THE ACCESS AND USE OF FEASY, II) DELAY OR INABILITY TO ACCESS FEASY; III) VIRUS, BUGS, TROJAN HORSES, SOFTWARE, INFORMATION, THIRD-PARTIES’ LINKED WEBSITES, SERVICES OBTAINED THROUGH THE USE OF FEASY OR ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF AMADEUS, IT AFFILIATES OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

THESE TERMS OF SERVICE DO NOT AFFECT ANY OF YOUR STATUTORY LEGAL RIGHTS THAT CANNOT BE EXCLUDED BY LAW. IF YOU ARE NOT SATISFIED WITH ANY PORTION OF THE FEASY SERVICES OR WITH THESE TERMS OF SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF FEASY .

Indemnification

You agree to release, indemnify, defend and hold Amadeus and its Affiliates, licensors and its and their officers, directors, employees and agents harmless from and against any liabilities, judgments, penalties, fines, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of Feasy, your violation of these Terms and Conditions or any documents referenced herein or your violation of any applicable law or the rights of a third party.

General provisions

Entire Agreement. These Terms of Service are the complete and exclusive statement relating to its subject matter and supersede all prior communications (oral or in writing) between you and Amadeus.

Assignment. You may not transfer any of your rights or obligations under these Terms of Service without our prior written consent. We may transfer any of our rights or obligations under these Terms of Service to any of our Affiliates or any third party designated by Amadeus.

Changes: Any new functionalities of Feasy will be subject to these Terms of Service. We reserve the right to amend sections of these Terms of Service at any time without further notice. The latest version will always be available on Feasy Website. Please visit Feasy Website from time to time to review the changes as they are binding to you. Your continued use of Feasy following the posting of changes to these Terms of Service or other policies means you accept the changes.

Severability. If any provision (or part thereof) of these Terms of Service is held by any court, or other competent authority to be void or unenforceable in whole or part, such void provision shall be deemed to be replaced by an enforceable provision with the closest effect possible to the original provision and these Terms of Service shall continue to be valid with respect to the other provisions and the remainder of the affected provisions.

Waiver. Any failure or delay by us in enforcing (in whole or in part) any provision of these Terms of Service will not be interpreted as a waiver of our rights or remedies.

Governing Law and Jurisdiction. This Agreement and any dispute or claim arising out of or on connection with them (including non-contractual disputes or claims) is governed by the laws of England and Wales, without regard to conflict of laws principle. You agree, for the sole benefit of us, that the courts of London, England, shall have exclusive jurisdiction over any dispute or claim (including non-contractual disputes or claims) You may have against us and/or our Affiliates arising out or in connection with this License Agreement. Nothing in this section shall limit our right to take proceedings against You in any number of other courts of competent jurisdiction (including arbitration courts), whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
